TERMS & CONDITIONS

Reservations, Deposit and Payment:

A deposit of $1000 per person or 25% of the total tour cost, whichever is higher, is required in order to commence booking and confirming services requested. Final payment will be due 90 (in some instances 120) days prior to departure. Additional deposit requirements may apply to cover advance purchase of airfares and cruises, and or other special packages such as holiday premium space. Reservations made less than 90 days prior to departure require full payment at time of booking. Travel e-vouchers are issued within two weeks of travel.

Groups:

If you are traveling as part of a group of 10 or more adults, different deposit, payment, and cancellation policies may apply. See your group contract for details.

Air Transportation:

Air transportation (where included) is based either on contracted bulk fare(s) in economy or published rates, whichever is less expensive at the time of booking. Premium classes of services will be utilized on some occasions and will be quoted as such. All fares are subject to change and guaranteed only once ticketed. Latin Travel Direct cannot assume responsibility for the default of any airline carrier, schedule changes, cancellations, or delays.

Hotels:

Unless requesting / booking premium room type, all accommodations are based on "Run-of-the-House" basis. Room assignments are made by hotel management upon arrival. We reserve the right to substitute hotels of the same or superior category. Some hotels impose minimum stays during certain periods of the year (such as Carnival in Rio), conventions, or peak travel dates. Hotels require a credit card or cash deposit at time of check-in for incidental charges. Guests arriving before hotel’s check-in or departing after hotel’s check-out times will be subject to additional payment.

Meals:

On all flights, meals and snacks are served according to airline’s policy. Meals (table d’hote) are included as specified in your selected itinerary. All other meals are the passengers’ responsibility. Beverages are not included.

Transfers and Sightseeing:

Transfers, including inter-city travel, to/from airports, hotels, and trains are included, as per the itinerary. On independent and locally hosted programs, the sightseeing by motor coach is operated by local companies and may consist of multi-national participants and multi-lingual guides. Private services available upon request.

Cancellations, Refunds & Changes:

For cancellations received more than 91 days prior to departure, a fee of US$500.00 per person will be charged (plus any applicable air cancellations). Cancellations received between 90 and 61 days prior to departure, a fee of $750.00 per person will be charged (plus any applicable air cancellations). Cancellations received between 60 and 31 days prior to departure will be charged 45% of the tour cost per person (plus any applicable air cancellations). Cancellations made between 30 and 8 days prior to departure will be charged 75% of the total tour cost per person (plus any applicable air cancellations). Cancellations made 7 days or less prior to departure will be charged 100% per person. No refund for no-show. There may be special payment and cancellation policies incurred during holiday/peak periods and for certain cruises or special packages, when there is no refund for changed or cancelled land/air services. No refunds will be given for unused portions of tour components or hotel stays. We reserve the right to impose a $150.00 fee per person fee for any changes, including name substitutions made once initial payment has been received (when permitted by the providers). Name changes are subject to provider acceptance and penalties will be governed by such conditions. Once scheduled air tickets are issued you will be bound to the refund and cancellation penalties set forth by the issuing airline. Name changes similarly are subject to the airline’s policies and may not allow for name changes. Paper tickets must be returned at time of cancellation. Airline tickets are non endorsable or transferable. All cancellations MUST BE RECEIVED BY LTD IN WRITING.

Tour Prices:

All rates are subject to chance. Prices appearing on our web site do not necessarily correspond to published rates of respective establishments and/or services. Wherever applicable the tour operator will apply bulk or net contract rates from airlines, hotels and other suppliers involved. The final rates include planning, communications, and all other operational costs.

Validity/Rate Fluctuations:

All rates described on this web site were valid at the time posted and are subject to change without prior notice. Rates may be affected by, but not limited to, currency fluctuation, fuel surcharges, convention dates.

Land Only Rates:

All programs may be purchased without our airfare; however, a three night minimum per country is required. Land Only rates do not include any air transportation, international or internal/regional flights.

Airport Taxes, Customs/Immigration Fees:

Are not included in rates unless otherwise specified. United States taxes and fees must be prepaid together with the airfare. Latin American airport taxes must be paid locally in local currency and is the responsibility of the passenger. Some countries, such as Chile, also charge “reciprocity fee” at time of entry.

Travel Documents:

U.S. citizens require a valid passport when traveling aboard. Central and South America countries require that your passport have more than 6 months remaining before expiration. Brazil currently requires U.S. citizens to obtain a tourist visa prior to arrival. Non-U.S. citizens are advised to check with their respective consulates. It is the sole responsibility of the passenger to have proper travel documents before starting the tour. Latin Travel Direct is not responsible for problems arising due to improper travel documentation. If entering Chile via Santiago, currently US citizens will be charged a $100.00 (reciprocal) visa fee (US currently charges this amount to Chilean Citizens). A parent traveling with minors (under 18) or a minor traveling alone must carry notarized permission from both parents including non-traveling parent(s), or notarized copy of deceased parent's death certificate, or "sole custody" or "Father Unknown" documents as required by the country visiting. Due to constant changes on entry/reentry requirements, we suggest you contact the Consulate General for the country/countries you are visiting for up-to-date information. Foreign nationals may be required to have Transit-Visas if connecting in the United States, or other points of connections. Furthermore, some countries require certain vaccinations (such as Yellow Fever) when traveling to or within some Latin American countries, or coming from certain countries. Baggage:

Baggage allowance is usually 44 pounds (two bags maximum, plus one carry-on not to exceed 45 inches in combined overall dimensions) per paying passenger for all trips. Limitations on checked baggage (not to exceed 44 pounds) may apply during peak travel seasons or embargos. Any overweight or oversized luggage (larger than suitcase size) will be carried, if at all, subject to load restrictions and at additional charges by the carrier/vessel. Baggage loss and or claims are governed solely by rules, regulations and limitations set by the applicable airline, cruise vessel, hotel, or lodge. Charters or smaller planes have different baggage/weight regulations. Certain airlines impose a fee per bag, per flight. For up-to-date information on baggage allowance, please consult with the airline(s) directly. Baggage regulations change constantly.

Insurance:

It is strongly recommended and is available at a nominal fee to cover cancellation charges, trip interruption costs, accidents and baggage loss or damage. Latin Travel Direct accepts no responsibility for loss or damage to baggage or other personal effects. Insurance premiums are non refundable upon purchase. For further details click here

Responsibility:

The Operator's and/or their agent's liability is limited. They act as agents for the Participant in relation to travel and accommodations whether by motor coach, private car, boat, aircraft, or any other mode of transportation. The Operator, and its parent, subsidiaries, and affiliates will not be responsible or liable for injury, personal injury, property damage, property and other losses, accident, delay or irregularity which may be caused either by reason or defect, through the acts or default of any company or person contracted in conveying passengers or in carrying out the arrangements of the tour, or as direct or indirect acts of God, dangers of the sea, fire, breakdown of machinery or equipment, acts of governments or other authorities de jour or de facto, wars, hostilities, civil disturbances, strike(s), riots, theft, pilferage, epidemics, quarantines, medical or custom regulations, or from any other cause beyond the Operator's control. The Operator reserves the right to decline to accept any participant as a member of the tour, or to cancel a tour if necessary. The sole and exclusive responsibility and liability of any airline used in the Operator's programs shall be in accordance with and as limited by the contract of a carriage in the participant's ticket, the applicable tariffs, and the provisions of the Warsaw Convention. Please note, hotels may require security deposits (in some cases cash) at their discretion.

Independent Contractors:

All tour services, transportation, and accommodations (the "services") provided in our tour packages are furnished by independent contractors over which we exercise no control. The Operator makes no guarantees or warranties, express or implied, regarding any such services. This includes, but is not limited to transfers, flights, cruises, tours, services and accommodations purchased or provided, as well as other features listed or not listed in this contract. The Operator reserves the right to substitute any hotel for any reason. The Operator assumes no liability for hotel overbooking resulting in inconvenience and/or substitute accommodations being provided, whether of a similar or lesser quality and location. The Operator will not be responsible or liable if any of the services, features, or facilities described on our web site that cease to be available or fail for any reason.

Entire Agreement:

In the event any paragraph of this agreement shall be declared invalid or void by any court, such declaration shall not invalidate the entire agreement and all other paragraphs of the agreement shall remain in full force and effect. Any claim or litigation arising out of or relating to this agreement, or the breach or validity thereof shall be brought in Dade County, Florida, the location of Latin Travel Direct, corporate offices, and the governing law shall be the laws of the State of Florida.
